Despite the fact that Constitution of Virginia and statutes still prohibit same-sex marriages in Virginia, Virginia has recognized same-sex marriages and allowed same-sex couples to get married since October 6, 2014. By refusing to hear the case of Bostic v. Schaefer, the Supreme Court of the United States allowed a lower court ruling to stand that invalidated the 2006 amendment to the Virginia Constitution defining a marriage between a man and a woman.

On June 26, 2015 in Obergefell v. Hodges the Supreme Court of the United States went one step further and required all states to recognize same-sex marriages performed in all states and territories of the United States and to issue marriage licenses to same-sex couples. With these Supreme Court rulings, family law in Virginia has transformed from a minefield for same-sex partners into a level playing surface where all individuals are treated the same under the law no matter their gender or sexual preference.
